Powers of Attorney

Home > Powers of Attorney

A Lasting Power of Attorney is a legal document that allows you (the Donor) to choose someone (the Attorney) to make decisions on your behalf when you no longer wish to make those decisions, or you lack the mental capacity to do so.

We believe anyone over 18 should make a power of attorney, although most people leave it to later life to do so.

There is obviously a risk that the Attorney could abuse the responsibility you give, and not deal with matters as you would wish.  However, by choosing attorneys they can trust in conjunction with expert advice the risks can be significantly minimised.

There are two types of Lasting Power, covering property and financial affairs, and health and welfare. You may make either or both types of Lasting Power, but it is important to note that a Lasting Power has to be registered with the Office of the Public Guardian before it can be used and naturally we can help with those arrangements.

You can only make a power of attorney whilst you have capacity to understand the nature and scope of the document you are making so it is important not to leave it too late.

If you own an interest in a business, such as a company or partnership, we can help in those circumstances and any other actions that may be required.

Unlike a Will, which comes into effect when you die, a power of attorney directly affects you and we consider it of vital importance that you receive specialist advice you deserve before creating a power of attorney.
